Susan J. Salehi Attorney at Law

Chapter 7 bankruptcy, sometimes call a straight bankruptcy is a liquidation proceeding. The debtor turns over all non-exempt property to the bankruptcy trustee who then converts it to cash for distribution to the creditors. The debtor receives a discharge of all dischargeable debts usually within four months. In the vast majority of cases the debtor has no assets that he would lose so Chapter 7 will give that person a relatively quick “fresh start”.

You can file a Chapter 7 case every 8 years. If you are not eligible to file another Chapter 7 but need relief from creditors, you can be eligible to file a Chapter 13 case. The debtor received a discharge under Chapter 7, 11 or 12 more than four years ago; or the debtor received a discharge under Chapter 13 more than two years ago. When a motor vehicle was purchased within 910 days of the filing and a secured creditor has a lien on it, the creditor retains the lien until payment of the entire debt has been made.

Many of our clients come to us after all other options have failed. They have a judgment against them and wages are being garnished or a bank account is being levied. Avoid the ostrich approach to your financially precarious situation. Don’t stick your head in the sand and hope someone will come to your rescue. The Law Offices of Susan J. Salehi remain fully functioning during this time.

We will continue to work on all existing and prospective cases and matters. We are primarily working remotely and are committed to providing you with the best legal representation possible and will continue to deliver the results you deserve and expect. You are behind on your mortgage or car loan, and want to make up the missed payments over time and reinstate the original agreement. You cannot do this in Chapter 7 bankruptcy. You can make up missed payments only in Chapter 13 bankruptcy.

Law Offices of Patrick Kavanagh

You have probably heard a lot of stories about bankruptcy, or are worried about what might happen if you file for bankruptcy. Actually, bankruptcy is designed to help you! If you have debts that you can’t pay, bankruptcy can help you find relief. We understand that sometimes there are circumstances beyond your control.

Bankruptcy can wipe out your debt. It helps you find a way to pay back your creditors, with a payment plan. You will have to pay back some of them in full, some partially, and some not at all, depending on your situation. If you have overwhelming debt that you feel you cannot reconcile, are recently laid off, have a lot of medical bill, or are otherwise in financial trouble, bankruptcy may be for you.

It can help you pay back some of your creditors and eliminate your debt. You can create a fresh start. However, bankruptcy is a very large step to take, and it helps to get another perspective. Patrick Kavanagh will give you a fair assessment of your situation and whether or not bankruptcy is right for you.

The Law Offices of Patrick Kavanagh will NOT force you into filing bankruptcy if it is not right for you. We value what is the most important for you, not filing as many bankruptcies as we can. We will represent your interests honestly and fairly, and will never push you into doing something that is not right for you.

Our Practice Areas:

Chapter 13 is a type of bankruptcy that requires you to make payments to your creditors for 3 to 5 years. You pay the creditors through a Chapter 13 Plan.

Law Office of Leonard K. Welsh

Bankruptcy is a way for people and businesses who owe more money than they can pay right now (‘debtors’) to either work out a plan to repay the money over time in a case under Chapter 11, Chapter 12 or Chapter 13, or to wipe out (‘discharge’) most of their bills in a Chapter 7 case. The filing of a Bankruptcy Petition immediately stops most actions to collect debts which were due at the time of filing, including Law Suits, Repossessions, and Foreclosures.

Based upon the circumstances, the court may, however, permit some Eviction, Repossession and Foreclosure actions to continue even after the case is filed. What chapter you choose to file under, what bills can be eliminated, how long payments can be stretched out, and other details are controlled by the Bankruptcy Code and the Federal Rules of Bankruptcy Procedure. These are federal laws, which means they apply all over the United States.

Leonard K. Welsh received his J.D. from Washington and Lee University in 1980. He holds national certification in both business and consumer bankruptcy law by the American Board of Certiciation (ABC) and has more than 28 years of experience practicing law.

His practice includes insolvency, bankrutpcy, business & farm reorganizaions, and debtor and creditor rights. Leonard is AV rated by Martindale-Hubbell, the highest designation, and has been named as a “Super Lawyer” three times by the publishers of Law & Politics Magazine.

D. Max Gardner – Attorney at Law

Max Gardner was admitted to the California State Bar in December, 1987 and has primarily focused his practice in Bankruptcy law since 1990. He is an AV rated attorney by Martindale Hubbell and a Certified Specialist in Bankruptcy law by the State Bar of California, Board of Legal Specialization.

Max Gardner represents debtors, creditors, trustees, and creditors’ committees in Chapters 7, 11, 12 and 13. He has extensive bankruptcy litigation experience in trying cases involving dischargeability of debts, preferences, fraudulent conveyances, objections to claims, objections to exemptions, plan confirmation and a variety of other actions obtaining declaratory relief from the Bankruptcy Court.

Chapter 7 Bankruptcy is some times referred to as “straight bankruptcy” or “liquidation bankruptcy”. The overall concept behind chapter 7 bankruptcy is that the trustee who is assigned by the bankruptcy court will liquidate or sell all of the person’s assets and in turn use these funds to pay off debts, and whatever debt is still left will be forgiven or discharged.

Our Practice Areas:

  • Chapter 7 Bankruptcy
Chapter 7 allows you to discharge your debt and most often keep your home and other assets.
  • Chapter 11 Bankruptcy
Chapter 11 Bankruptcy allows your business to remain in operation and retain control over most or all of your assets.
  • Chapter 13 Bankruptcy
Chapter 13 is an option if you can’t file Chapter 7 and/or wish to pay taxes or catch up your house payment.
