Nuti Hart LLP

Although formed in July 2016, Nuti Hart, LLP is a law firm over 20 years in the making. The principals, Greg Nuti and Chris Hart are each natives of the East Bay, born and bred. Both attended local high schools and after law school returned to the Oakland area to start families. In 1997, they met while working for a San Francisco-based law firm. There, Greg focused on commercial law and bankruptcy.

Chris began his career as a business litigator representing banks, auto finance companies and non-traditional lenders. His focus was on pre-judgment remedies, commercial collections, and class action defense including claims under California’s Business & Professions Code §17200. He moved to focusing on business litigation and complex transactions.

By 2001, the pair had moved to a small bankruptcy firm in San Francisco. There, another lawyer with long time East Bay roots, Kevin Coleman, joined as the third member of the team. Kevin had a wealth of bankruptcy experience beginning in 1994 when he clerked for the Honorable Mitchell Goldberg and then the Honorable Lynn Riddle.

This was the era of the dot.coms, or as it was affectionately known in the industry the “dot.bombs.” The group represented every entity in the bankruptcy process and gained experience across all disciplines of debt restructuring. In 2007, the group approached Philadelphia-based firm Schnader Harrison Segal & Lewis, about establishing a restructuring/bankruptcy litigation practice-group in San Francisco. There Greg, Kevin and Chris continued in their various specialties.

Together, the Nuti Hart team has the breadth of knowledge and experience comparable to a big firm’s Bankruptcy, Restructuring and Creditors’ Rights practice group. With our scaled-down boutique format, we also now have the agility to more directly address our clients’ needs. We are a hands-on team, who enjoys working together with our clients. To us, our clients’ stories are as important as our own, and we are honored to be a part of them.

Law Offices of Geva Baumer

One purpose of a Chapter 13, as opposed to a Chapter 7 is to enable a debtor to retain certain assets (for example, a home) that might otherwise be liquidated by a Chapter 7 Trustee. It also provides an alternative to Chapter 7 when a debtor has too much “disposable income” (the net monthly income exceeds the net monthly expenses) and usually results in much lower monthly payments then you were previously paying.

The purpose of almost any personal bankruptcy is to discharge existing debts by repaying all or a portion of debts, and to allow a fresh start on your finances. Once a discharge is granted, there is no longer a need to repay most of the debts that were incurred before an individual filed for bankruptcy. The only way to determine which Chapter to file under is to compare your options under the other available Chapters and be sure you have consulted with a local experienced bankruptcy attorney to properly analyze your options.

The automatic stay is a provision in the Bankruptcy Code that temporarily prohibits most creditors from continuing or commencing collection activities against you. When you file for bankruptcy, the automatic stay immediately goes into effect. The automatic stay prohibits most creditors from continuing with collection activities, which can provide welcome relief to debtors as well the opportunity to regroup during bankruptcy. There are some exceptions to the automatic stay.

Because of the immediate effect and nature of the automatic stay, the filing of the bankruptcy typically stops all collection actions, such as home foreclosures, evictions, car repossession, wage garnishment and bank levy. If a creditor knows about the bankruptcy but does not stop all collections against you, then the Court may find this creditor to violate the automatic stay and further charge the violating creditor with your damages, attorney fees and sometimes also punitive damages.

Practice Areas:

  • Chapter 7 Bankruptcy
  • Chapter 13 Bankruptcy

Law Office of Jeff D. Hoffman

At the Bay Area Law Office of Jeff D. Hoffman, we believe everyone deserves a chance at a fresh start after getting into serious trouble with debt. Depending on your specific circumstances, you may be able to avoid serious debt consequences such as wage garnishment, foreclosure, and auto repossession with the help of bankruptcy and debt reduction.

As a law office, we are bound by the strict ethical standards of the State Bar of California when we are providing our services, such as negotiating debt reductions. These services are also provided by non-lawyers; however, they do not have to answer to the State Bar or any other agency. From our office in the historic downtown Old Oakland district, near BART, the courthouse, federal building and convention center, we represent bankruptcy and loan modification clients throughout the San Francisco Bay Area.

We are only three short blocks from the 12th street BART station, and there is plenty of parking nearby our office. Our office is fully wheelchair accessible. For elevator access to our floor, enter from the back of the building on the 9th Street side, using the entrance in the employee parking lot. Are you having trouble managing your credit card bills, rent or mortgage payments and car payments?

Practice Areas:

  • Chapter 13 Bankruptcy: With a Chapter 13 payment plan, you can stop a foreclosure and/or repossession immediately, while sharply reducing or eliminating some types of debt and catching up with others over a three- or five-year period. You may even be able to get a car back that has been repossessed if you file bankruptcy quickly enough.
  • Chapter 7 Bankruptcy: Filing Chapter 7 can get you immediate debt relief, such as stopping wage garnishments and bank levies, and creditor harassment such as phone calls. Filing chapter 7 bankruptcy eliminates certain types of debt permanently within just a few months.
  • Home Foreclosure: You can save your home with a standard chapter 13 bankruptcy or a new loan modification chapter 13 bankruptcy. Jeff will carefully go over your bankruptcy and loan modification options for avoiding foreclosure, beginning when you receive your first notice of default.

Whether the inability to pay creditors is due to loss of employment, medical expenses, taxes, etc., bankruptcy can help resolve the problem.

The two most common chapters of bankruptcy are Chapter 7 and Chapter 13. Chapter 7 allows individuals to eliminate much if not all of their debt by liquidating non-exempt property to repay creditors. Chapter 13 permits individuals to keep their property, but they must repay all or a portion of their debts over a set time period. Bankruptcy cases are under the exclusive jurisdiction of the Federal Courts.

Whether it is a Chapter 7 or 13, filing for bankruptcy can relieve the stress of your financial situation. The bankruptcy laws changed in 2005 and with the complicated circumstances in these areas, it is highly recommended to seek advice of a bankruptcy attorney. The Law Office of Daphne Yeldell can help you find a way to deal with your financial situation and guide you through the challenges you face no matter what they are.

Boeing Law Offices

At Boeing Law Office, PC, the offices of Oakland bankruptcy and estate planning attorney Eric M. Boeing, we represent clients throughout the Bay Area. In bankruptcy matters, our focus is helping people more than businesses (though many of our clients are business owners).

We never represent creditors. In estate planning matters, almost all of our clients are regular people who want to save their heirs the costs of probate, and to name guardians for their children. We offer a free initial consultation so you can learn the benefits, risks, and likely outcomes of your matter.

At your consultation, you will get real answers to your questions. That way, you can make pressure-free, informed decisions about your options. Like most of our clients, you may have already been through a lot. You may have lost a home through foreclosure, had your car repossessed, or are having your wages garnished. You might be being sued by debt collectors. Or maybe those things haven’t happened yet, but the threats are looming.

Everyone’s particular situation is different, and those differences are critical to the outcome of your case. Call Oakland bankruptcy attorney Eric M. Boeing today to find out how the particular facts of your specific situation affect your case. When you file a case with the Bankruptcy Court, you immediately come under the Court’s protection. All debt collection attempts, including phone calls, letters, lawsuits, foreclosures, repossessions, and wage garnishments must stop immediately.

Both Chapter 7 bankruptcy and Chapter 13 bankruptcy provide you protection from your creditors and a discharge of certain kinds of debt. In Chapter 7 bankruptcy, the focus is on the discharge. Chapter 13’s defining characteristic is that it allows you to enjoy the court’s protection for five years. During those five years, no one can sue you, garnish you, foreclose on you, repo your car, nothing.
