An entrepreneur needs to be free to move to the next project with a minimum of interference. A Chapter 7 bankruptcy can be the best way to accomplish this goal. It allows business leaders to terminate a business and move forward because an independent trustee does the work of liquidation and is paid from the proceeds.

Law Offices of Patrick J. McNamara

The framers of the current Bankruptcy Law (BAPCPA 2005) intended it to be burdensome, complex and daunting! As a consequence, many Americans have been deterred from seeking Bankruptcy relief! The Law Offices of Patrick J. McNamara endeavor to explain the challenging new Bankruptcy Law in a friendly, non-judgmental fashion and are helping our clients to Fight Back and obtain the Bankruptcy relief they want and need!

We will counsel you and help you decide if the discharge of your debts via a straight Bankruptcy, Chapter 7, which can in some cases involve a liquidation of personal or corporate assets, or a court approved debt adjustment plan in Chapter 13, involving the repayment of creditors over time, is the vehicle that will give you the financial relief that you need.

We are a Debt Relief Agency. We help people file for relief under the Bankruptcy Code. Good people get into bad financial situations everyday through no fault of their own. They lose their jobs, can’t find comparable new employment, medical bills become overwhelming, and so on. There are many reasons why people find themselves in deep financial trouble.

With over 37 years Bankruptcy Law experience, Patrick is prepared to advise you as to whether your situation might call for you to file a Chapter 7 straight Bankruptcy or a Chapter 13 Bankruptcy in order for you to obtain financial relief, and about what to expect given the challenges posed by the recently enacted Bankruptcy Abuse Prevention and Consumer Protection Act of 2005.

The law offices of Patrick J. McNamara represent clients in two basic types of Bankruptcy proceedings: Chapter 7 Liquidation cases & Chapter 13 Debt Adjustment cases.

This is accomplished through a “discharge” and the way it is obtained depends on whether it is a Chapter 7 or Chapter 13 bankruptcy that is filed. Chapter 7 In a Chapter 7 bankruptcy, covered in Chapter 7 of Bankruptcy Code, all dischargable debts are discharged usually in a period of 3 to 4 months.

Chapter 13 In a Chapter 13 bankruptcy, covered in Chapter 13 of the Bankruptcy Code, a percentage of the debt is repaid through a 3 to 5 year plan depending on the Debtor’s income and expenses. After the plan is completed, the remaining dischargable debt is discharged and any non-dischargable debt remains.

There are limits to what kinds of property can be protected in bankruptcy and there are limits to what kinds of debts can be discharged. If the Debtor files a Chapter 7 bankruptcy and has equity in property exceeding in value the amount of the allowed exemptions, the property will be sold to pay their creditors.

They can instead file a Chapter 13 and so long as the Debtor’s creditors will receive the dollar equivalent of what they would have received in a Chapter 7 case (had the property been liquidated) through the Chapter 13 plan, the property will be protected, but the Debtor has to pay some of the debt back in order for that to be accomplished.

EH Law Group

To get into a San Mateo Chapter 7 bankruptcy, you have to pass the “means test” which requires that your income be below a certain level. The means test is a formula designed for debtors with qualifying or lower income who need immediate relief within 90 days of filing. Generally speaking, the means test takes a debtor’s gross monthly income for the last 6 months and approved expenses into consideration. Though you might not qualify for a Chapter 7 bankruptcy if your income is “above” the means test, you may still be eligible for a Chapter 13 bankruptcy.

Practice Areas:

A San Mateo Chapter 7 bankruptcy is designed to get you immediate relief from your unsecured debts. The Chapter 7 can erase credit card debts, medical bills, repossessions, and stop lawsuits. Once your debts have been discharged in bankruptcy, the law prevents creditors from ever coming back to collect from you. You will get the clean slate you have been looking for in about 90 days.
  • CHAPTER 13
A San Mateo Chapter 13 bankruptcy results in a payment plan that allows you to repay some of your debt over 3 to 5 years with minimal interest. For example, you could make up missed mortgage or car payments to get current without penalties. Most importantly, the Chapter 13 bankruptcy allows debtors to retain their property. Under the right conditions, certain debts, like second mortgages and liens on real property may be stripped away.

  • Chapter 7
Most people are eligible for a Chapter 7 “straight” bankruptcy where they get rid of all their debts from credit cards, post-foreclosure mortgages, repossessed cars, medical bills, judgments and the like. Few people with an expert bankruptcy lawyer have any assets at risk in a Chapter 7. With the generous exemption scheme for property in California, almost 98% of bankruptcy debtors keep everything.
  • Chapter 13
Chapter 13 is the gold standard for consumers who need to reorganize their financial affairs. Among other things, a Chapter 13 may permit you to strip away an underwater 2nd mortgage, “cram down” a car loan to the value of the car and pay it at a lower interest rate, play catch up with back mortgage payments, pay co-signed student loans in full and pay off required tax debts to the exclusion of credit card debts.
