A successful adjustment of status applications results in permanent residency, a green-card. The entire process occurs in the United States, and is not available to people residing outside of the country. Typically, the first step in the process is for the United States citizen to file an immigrant visa petition, Form I-130, on behalf of his our her spouse.

K-1 visas are available to foreign-national fiancé(e)s of United States citizens. The process of receiving a K-1 visa begins with the filing of I-129F petition filed by a U.S. citizen. Once USCIS approves the I-129F petition, the K visa file is forwarded to the State Department’s National Visa Center for further processing. Some immigrants initially receive a grant of legal permanent residency on a conditional basis.

If permanent residency was received on the basis of a marriage that was less than two years old at the time of the grant of permanent residency, then the permanent residency will be conditional. A person placed in removal proceedings must be served with a Notice to Appear (NTA).

The NTA will outline the Department of Homeland Security’s allegations against a person and will list the provisions of law pursuant to which the person is charged as subject to removal. If a person cannot receive a grant of asylum because of the one-year filing rule or due to an unfavorable exercise of discretion, withholding of removal may still be available.
